Terms of service
General Terms and Conditions
-
Orders:
We ship goods according to the buyer's instructions and specifications. Insured shipping can be arranged upon request. Please always include your customer number (if known), as well as the names and order numbers of the desired items when placing your orders. We are not liable for incorrect deliveries resulting from inaccurate orders. Orders constitute a purchase offer. The contract is concluded upon order confirmation and/or delivery of the goods.
-
Order Information:
Your order will generally be processed and dispatched within 3 business days. If you have not received your goods after an extended period of time, please contact us by phone, as transmission errors cannot be entirely ruled out in rare cases.
-
Prices:
The stated prices apply (including VAT). They correspond to those on the current order form. Upon the publication of a new order form, all previously printed prices become invalid. Price changes are reserved due to the uncertain and fluctuating price situation on world markets and/or currency fluctuations. Errors and printing mistakes are reserved.
-
Shipping Costs:
Shipping costs are borne by the buyer. Within Germany, we deliver free of postage and packaging for orders with a value of €59.00 or more. Below this amount, shipping costs are €4.95. We reserve the right to adjust these rates in the event of changes in freight rates or postage charges.
-
International Deliveries:
Deliveries to European countries outside Germany are only carried out against advance payment. In addition to domestic shipping terms, we charge the additional costs for international shipping. We ask foreign customers to agree on the payment method with us when placing an order. Deliveries overseas are only carried out upon request and in exceptional cases.
-
Payment Terms:
Our invoices are due immediately and payable within 10 days without deduction.
-
Reminder Fees:
1st reminder free of charge; 2nd reminder €2.50. If the payment deadline set passes without result, the matter will be handed over to a collection agency commissioned by us.
-
Liability:
If there is a defect in the goods, the statutory provisions on liability for defects apply. JURA assumes no liability for damages resulting from incomplete, delayed, or non-delivery if these are caused by fire, strikes, lockouts, force majeure, or other circumstances beyond our control. In the event of non-delivery or delayed delivery by upstream suppliers, JURA is entitled to withdraw from the contract with the customer if the goods are not deliverable or are temporarily not deliverable despite the prior conclusion of a corresponding purchase contract. JURA undertakes to inform the customer immediately of the non-availability and to reimburse the customer for any consideration without delay. JURA is only liable for intent and gross negligence. The same applies to the personal liability of employees, representatives, and vicarious agents. However, this limitation of liability does not apply to personal injury, claims under the Product Liability Act, cases of fraudulent concealment of a defect, or the breach of essential contractual obligations, whereby in the latter case liability is limited to the foreseeable, typically occurring damage. The statutory rights of our customers are not waived by the above limitations of liability. -
Cancellation Policy:
Right of Cancellation:
You may revoke your contractual declaration within 14 days without stating reasons in writing or – if the goods are handed over to you before the deadline expires – by returning the goods. The period begins upon receipt of this notice in text form (e.g. letter, fax, e-mail), but not before the goods have been received by the recipient and not before we have fulfilled our information obligations pursuant to Article 246 § 2 in conjunction with § 1 paragraph 1 no. 10 EGBGB. To comply with the cancellation period, it is sufficient to send the cancellation notice or the goods in time.
The cancellation is to be directed to: JURA NATURHEILMITTEL GmbH, Nestgasse 2-4, D - 78464 Konstanz.
by e-mail to: info@hildegard.de
Consequences of Cancellation:
In the event of an effective cancellation, the services received by both parties must be returned and any benefits derived (e.g. interest) must be surrendered. If you are unable to return or surrender to us the service received and any benefits derived, either in whole or in part, or only in a deteriorated condition, you must compensate us accordingly. You are only required to pay compensation for the deterioration of the goods and for benefits derived to the extent that the benefits or the deterioration are attributable to handling of the goods that goes beyond examining their properties and functionality. "Examining the properties and functionality" means testing and trying out the respective goods, as is possible and customary in a retail store. Items that can be sent by parcel are to be returned at our risk. You must bear the regular costs of returning the goods if the delivered goods correspond to those ordered and if the price of the item to be returned does not exceed €40.00, or if, in the case of a higher price, you have not yet made the consideration or a contractually agreed partial payment at the time of cancellation. Otherwise, the return is free of charge for you. Obligations to refund payments must be fulfilled within 30 days. The period begins for you with the sending of your cancellation notice or the goods, and for us with their receipt. Your right of cancellation expires prematurely if the contract has been fully performed by both parties at your express request before you have exercised your right of cancellation.
-
Retention of Title:
Ownership of the products delivered by us shall not pass to our customers until full payment of the purchase price has been made, unless a transfer of ownership by operation of law has occurred beforehand.
-
Choice of Law:
Exclusively German law applies to the legal relationships with our customers.
-
Set-Off/Retention:
A customer's right to set-off/retention only exists in the case of an undisputed or legally established counterclaim.
-
Severability Clause:
Should individual provisions of these general terms and conditions be wholly or partially legally invalid or lose their legal validity at a later point in time, the remaining provisions of the general terms and conditions shall not be affected thereby. The invalid provision shall be replaced by an effective regulation that corresponds to or most closely approximates the economic purpose and intent of the invalid provision.
-
Place of Performance / Jurisdiction:
The place of performance and jurisdiction for all legal disputes in commercial transactions, regardless of the reason, is Konstanz am Bodensee. Otherwise, the statutory provisions apply.
